1. Acceptance of Terms

2. Booking Terms and Conditions
By booking a trip with Trekstar LLC ("Trekstar," "we," "us," "our"), you agree to the following Booking Terms & Conditions, which are incorporated into this agreement.

• 2.1. Contract: Your booking is confirmed and a contract is made when we issue a written confirmation (invoice or email). It is your responsibility to check all details are correct.

• 2.2. Pricing & Inclusions: Prices are subject to change until full payment is received. All prices and availability are not guaranteed until booked. Please see your itinerary for specific inclusions and exclusions.

• 2.3. Payments & Cancellation by You: All payments are due per the schedule on your invoice. Our cancellation policy is tiered and based on the date of cancellation relative to the trip departure. Please refer to your specific booking for the applicable policy. Cancellation fees will apply and can be up to 100% of the trip cost.

• 2.4. Changes or Cancellation by Us: We reserve the right to cancel or modify a trip due to factors beyond our control (see Force Majeure, Section 8) or if minimum passenger numbers are not met. If we cancel a trip, your sole remedy is a full refund of monies paid to Trekstar. We are not responsible for expenses incurred by you in preparation for the trip (e.g., visas, vaccinations, non-refundable flights).

3. Customer Responsibilities
You are responsible for:

• 3.1. Travel Documents: Obtaining a valid passport, visas, vaccinations, and all other necessary travel documents prior to departure.

• 3.2. Travel Insurance: You are strongly advised to purchase comprehensive travel insurance that includes coverage for trip cancellation/interruption, emergency medical evacuation, emergency medical expenses, and baggage loss. Trekstar shall not be liable for any losses incurred due to your failure to obtain adequate insurance.

• 3.3. Health & Conduct: Ensuring you are physically and mentally fit for the trip. You agree to comply with all local laws and regulations and adhere to a standard of conduct that is respectful to other travelers and locals. We reserve the right to remove any person from a trip who jeopardizes safety or impedes the enjoyment of others, without refund.

4. Assumption of Risk
You acknowledge that travel, including the adventures and activities sold by Trekstar, involves inherent risks, dangers, and hazards. These can include, but are not limited to: accidents in remote locations without medical facilities; forces of nature; terrorism; civil unrest; theft; cancellation or changes in itinerary; and transportation failures. You voluntarily assume all such risks associated with your travel and activities.

5. Intellectual Property License
All content on this website (text, graphics, logos, itineraries, images) is the property of Trekstar LLC or its suppliers and is protected by copyright and trademark laws. You may access content for personal, non-commercial use only. Any other use, including reproduction or publication, is strictly prohibited.

6. User-Generated Content
You grant Trekstar a royalty-free, perpetual license to use any content (reviews, photos, comments) you submit to us for marketing and promotional purposes. You warrant that you own the rights to any content you submit.

7. Third-Party Services
Trekstar acts as an intermediary between you and third-party suppliers such as airlines, hotels, tour guides, and transportation companies ("Suppliers"). We are not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier or for any personal injuries, death, property damage, or other losses or expenses resulting therefrom.

8. Force Majeure
Trekstar shall not be liable for any failure or delay in performance under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemics, government restrictions, fires, natural disasters, weather, or transportation failures.

9. Disclaimer and Limitation of Liability

9.1. General Disclaimer: The information, software, products, and services published on this website may include inaccuracies or errors, including pricing errors. Trekstar LLC, its members, and its Suppliers do not guarantee the accuracy of, and disclaim all liability for, any errors or other inaccuracies relating to the information and description of the travel services displayed on this website (including, without limitation, the pricing, photographs, list of hotel amenities, general product descriptions, etc.).

9.2. No Warranty: All travel services are provided "as is" without warranty of any kind, either express or implied. Trekstar specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.3. Limitation of Liability to the Maximum Extent Permitted by Law:
TREKSTAR LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SAVINGS, LOSS OF DATA, OR OTHER DAMAGES RESULTING FROM:

• (A) YOUR USE OF OR INABILITY TO USE THIS WEBSITE;

• (B) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED THROUGH THE WEBSITE;

• (C) ANY TRAVEL SERVICES BOOKED VIA THIS WEBSITE, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE ARISING FROM THE ACTS OR OMISSIONS OF ANY SUPPLIER OR OTHER THIRD PARTY.

9.4. Cap on Liability: IN NO EVENT SHALL THE AGGREGATE LIABILITY OF TREKSTAR LLC, WHETHER IN CONTRACT, WARRANTY, tort (including negligence, whether active, passive, or imputed), OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF THE WEBSITE OR BOOKING OF TRAVEL SERVICES, EXCEED THE TOTAL AMOUNT OF FEES YOU PAID TO TREKSTAR FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

9.5. Non-Excludable Liabilities: NOTHING IN THIS AGREEMENT SEEKS TO EXCLUDE OR LIMIT LIABILITY FOR (I) DEATH OR PERSONAL INJURY CAUSED BY THE NEGLIGENCE OF TREKSTAR OR ITS EMPLOYEES; (II) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (III) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

10. Indemnification
You agree to defend and indemnify Trekstar LLC and its affiliates, and any of their officers, directors, employees, and agents from and against any claims, causes of action, demands, losses, damages, or other costs (including reasonable attorneys' fees) brought by third parties as a result of your breach of this Agreement or your violation of any law or the rights of a third party.

11. Dispute Resolution; Mandatory Arbitration and Class Action Waiver

• 11.1. Arbitration: Any dispute or claim relating to these Terms or your use of our services shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court. The arbitrator's award shall be final and judgment may be entered upon it in any court having jurisdiction.

• 11.2. Class Action Waiver: YOU AND TREKSTAR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12. Governing Law
This Agreement and any dispute arising from it shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law principles.

13. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to the website. Your continued use of the website or our services after changes are posted constitutes your acceptance of the modified terms.
